An assignment must be recorded to enforce a trademark
application/registration. An assignment must be recorded
in order to prevent the mark from being cited by the
Office against a new application for a similar mark
filed by the assigned.
There is not time limit for recording an assignment
or merger after the assignment or merger has occurred.
An official certificate by a public officer or a certified
copy thereof as well as a certified copy of the assignment
deed or merger agreement may be used to support a request
to the Office to record an assignment.
The documents used for recording an assignment must
be translated into Spanish language.
A simple signed POA by the assignor or assigned must
be filed. However, no new POA must be submitted if the
assignment is filed by the attorney / agent of record.
